SB 1043 was signed by the Governor on April 16th 2012. A new section of law codified in the Oklahoma Statutes as Section 2-6-109 of Title 27A, reads as follows:

No later than August 31, 2012, the Department of Environmental Quality shall convene a working group including municipalities, consulting engineers, technical experts, and the general public to explore opportunities for water reuse and define the process for variances from the construction and operations standards relating to indirect potable reuse, Category 2, and Category 3 reuse waters.

The working group convened and subcommittees were formed to cover the criteria outlined in SB 1043. The initial two groups formed covered water reuse technology and water quality standards. Later, it was determined that a third group was necessary to evaluate the needs of the oil and gas industry. In addition to the water reuse regulations approved over the last 3 years, regulations to implement the findings of the subcommittees are scheduled for submittal to the legislature for approval in the spring of 2015. Some of the new modifications to our water reuse standards include:

  • Adding regulation for ozone and membrane processes.


  • Adding a new Category for water reuse to cover activities within the wastewater treatment plant.


  • Allowing reuse water to be used for make-up water for oil and gas production and hydraulic fracturing.


  • Allowing reuse water to be used in industry for once-through cooling systems and closed loop systems such as boiler feed water
